Lex Arbitri Indonesia – The Law, Practice and Place of Commercial Arbitration in Indonesia Today

In this article, Dr Sam Luttrell provides an overview of Indonesia's arbitration law. This article is directed at legal practitioners and foreign investors in Indonesia, and its purpose is to comment on the viability of arbitration as a means of avoiding Indonesian courts, and to identify the way in which Indonesian judges approach matters relating to arbitration. In particular, the focus is on the enforcement and recognition of foreign arbitral awards in Indonesia—a topic that has been of no small significance since the 2004 decision of the Supreme Court of Indonesia to overturn a lower court’s annulment of the quarter billion US dollar arbitral award rendered in Karaha Bodas Company, LLC v Perusahaan Pertambangan Minyak Dan Gas Bumi Negara.
